The Premier League has sent a letter written by its lawyers to the 4 shit stirring clubs and cc'd all other teams effectively warning them any legal action would be doomed to fail

Well I am utterly appalled.
After all my efforts Foxtel have refused to assist and the Man Utd v WHU game will remain on delayed broadcast at 2.30am EST after the Sheffield Utd v Wigan live game.
I mean with all due respect, how many supporters in Australia are there for Sheffield Utd and Wigan compared to WHU and Man Utd? I mean really! What type of a choice is this - they should show both games!
The situation is as follows:
1. Foxtel holds the exclusive rights to the broadcast of EPL (English Premier League) games in Australia.
2. All EPL matches in the final round are, quite appropriately, played at 3pm on the final Sunday so as to ensure that the final positions cannot be influenced by teams knowing the result of other matches.
3. This means that broadcasters need to choose which game they broadcast live assuming that they have only one medium of delivery.
4. Foxtel has an effective MONOPOLY and therefore we have no means of legally watching a live broadcast of the match. (I am aware of several people who will watch the match via live feeds that breach licences - I cannot participate in such events nor can I ever promote them.)
5. I made representations to Foxtel management with a suggestion that the Man Utd v WHU game be shown live on their Main Event channel and I offered to pay for it!
6. They have refused. They claim that they are choosing to broadcast our game and that it is reasonable to do so on a 2.5-hour delay commencing at 2.30am on Monday morning.
This is grossly unfair and not only that its poor service and a poor business decision! Once again, this is a £50m match and we are denied the right to see it LIVE. Who really enjoys seeing a match on delay when they know they could see it live? Internationally other broadcasters are using their multi-channel facilities to broadcast 2+ matches when this type of thing occurs. We are left out in the cold and I am NOT impressed.
However, I am not taking this lying down and I will continue in David vs. Goliath mode once again until all avenues are exhausted.
I have been the staunchest of protectors of copyright and licensing throughout my career but where better is the case made for the exhaustion of copyright/licence than this example when the licensee refuses to adequately exploit that licence? It is trite to claim that broadcast at 2.30am on a Monday morning is effective exercise of the licence as the broadcast is not live nor is it convenient to the audience!
In such a case, even more so when the licence holder is an effective monopoly, another provider should be permitted to broadcast live.
I will be making representations to the Minister for Communications in Canberra tonight!
Send your emails of support as well to the press, to Foxtel and elsewhere as we should have the choice are are promised.
Worst case scenario, I still plan to have LIVE radio broadcast of the Man Utd v WHU game at The Hakoah Club in Sydney and I'll be funding part of the bar at The Hakoah Club in Bondi, Sydney for OZ Hammers.

This is stupid. I remember two years ago when west brom, norwich, southampton and crystal palace all fought to survive relegation on the final day and fox sports showed two games live. Why cant they just do that again?

there are 2 other live sports events on that clash...superbikes which has a big following apparently and the final of the Rome Masters tennis (tho I see Federer was knocked out overnight @ $1.04)

No matter what happens West Ham will always be there just to make up the numbers. Lets not delude ourselves. The players we attract are usually other clubs rejects at the wrong end of their careers. Look atthe last few years signings and take note. The only decent players with actual potential were Tevez and Mashers, and we were just a shop window for those two.
